Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Birdie Buddy (the “Service”), a golf performance tracking application operated by Birdie Buddy, a Canadian small business based in Ontario, Canada (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Birdie Buddy lets you log golf rounds, record shots, view strokes-gained statistics, import scorecard photos, and record your mindset and intentions for each round. Some features described on our website are marked “Coming Soon” and may not be available yet. We may add, change, or remove features at any time.
The Service provides data and practice suggestions. It is not in-person golf instruction, and we do not guarantee lower scores or any particular result.
2. Accounts
You must provide a valid email address and keep your login credentials confidential. You are responsible for activity on your account. You must be at least 13 years old, or the minimum age required in your province or country to consent to an online service.
3. Subscriptions, trial, and billing
Paid access is sold as a subscription billed in Canadian dollars (CAD):
- Monthly plan: $15 CAD per month
- Annual plan: $125 CAD per year
New subscriptions include a 7-day free trial unless we state otherwise at checkout. You will not be charged during the trial. After the trial, Stripe charges the selected plan automatically until you cancel.
Payments are processed by Stripe. We do not store your full card number. Taxes may be added where required by law.
4. Cancellation and refunds
You may cancel at any time through the Stripe customer portal linked from the Service. Cancellation stops future renewals. You keep access until the end of the current trial or paid period.
Except where required by Canadian consumer-protection law (including Ontario’s Consumer Protection Act), fees already paid are non-refundable, including unused time in an annual plan. If you believe a charge was made in error, contact us at hello@birdiebuddy.app and we will review it.
5. Your content
You retain ownership of rounds, shots, mindset notes, and photos you upload. You grant us a limited licence to host, process, and display that content solely to operate the Service for you — including using automated tools to parse scorecard photos.
Do not upload content you do not have the right to use, or content that is unlawful, infringing, or harmful. We may remove content or suspend accounts that violate these Terms.
6. Acceptable use
You agree not to misuse the Service, including attempting to access other users’ data, reverse engineer the Service except as allowed by law, overloading our systems, or using the Service to break the law.
7. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Statistics and suggestions may contain errors.
8. Limitation of liability
To the fullest extent permitted by law, Birdie Buddy and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or golf performance. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $50 CAD if you have not paid.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence where such a limit is prohibited.
9. Changes
We may update these Terms. We will post the new version on this page and update the “Last updated” date. Continued use after changes take effect constitutes acceptance. If you do not agree, cancel your subscription and stop using the Service.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction, except that you may have additional rights as a consumer in your province of residence.
